Terms of Use for “Smart City Explorer” (v. 0.1 8/2024)
- Introduction
- These Terms of Use (“Terms”) apply to the mobile application Smart City Explorer (“Application”), which was developed as part of the project Education for Smart Slovakia (004UCM-4/2023), approved by the Cultural and Educational Grant Agency of the Ministry of Education, Research, Development, and Youth of the Slovak Republic (KEGA). The project is managed by the Faculty of Social Sciences, University of St. Cyril and Methodius in Trnava. The technical management of the application interface (mobile application, web, and administration) is provided by Brandinstitute, a civic association (ID 42174180), and the application was developed by AdBird, s.r.o. (ID 47812699).
- Account Definitions
- Student: Users who have access to educational modules, quizzes, and can participate in challenges and leaderboards. They can collect points for successfully completing lessons and modules, which can be exchanged for goods or services. There is no legal entitlement to these goods or services, and they cannot be claimed.
- Teacher: Users who have the right to create and manage courses and quizzes and monitor students’ progress. Teacher accounts require approval from the administrator and must be affiliated with a specific educational institution.
- Municipality: Users with the same rights as teachers, plus access to regional data and the ability to organize Challenges. They cannot add or modify lessons but can create system-wide Challenges to engage residents (Students). Municipality accounts must be approved by the administrator.
- Usage Rules
- The Application is intended for non-commercial educational purposes. Using the Application for other purposes without prior written consent is prohibited.
- Users are responsible for protecting their login credentials.
- The Application must not be used for unlawful purposes or to distribute content that is offensive, obscene, discriminatory, or otherwise inappropriate.
- User Rights Regarding
- User-Generated Content
Users, particularly in the case of Assignments, complete Assignments created by Municipalities. Users earn points for completing assignments, which can then be exchanged for goods or services. The ownership of the completed assignment is considered the property of the Application administrator, as it was indirectly compensated for technically.

- Copyright and Content
- All content in the Application is protected by copyright and other legal regulations. Content must not be copied, reproduced, distributed, or used for commercial purposes without the rights holder’s consent.
- Compliance with Local Laws
- The Application is primarily intended for users in Slovakia and the Czech Republic and complies with the laws of these countries.
- Privacy Protection
- The Application collects and processes personal data in compliance with GDPR and national data protection regulations. Detailed information about data processing and protection is provided in the Privacy Policy.
- Changes and Termination
- The developers of the Application reserve the right to modify the content of the Application or change these Terms at any time without prior notice.
- Warranties and Limitation of Liability
- The Application is provided free of charge “as is” without any warranties.
- The developers do not guarantee uninterrupted or error-free operation of the Application.
- The developers are not responsible for any direct or indirect damages caused by the use of the Application.
- Dispute Resolution
- All disputes arising from the use of the Application are subject to the jurisdiction of courts in Slovakia or the Czech Republic.
- Mediation must be attempted before filing a lawsuit.

- The mobile application Smart City Explorer (hereinafter referred to as “Application”) respects its users’ privacy and is committed to protecting personal data collected through the Application. - The Application may collect data such as name, age, email address, school affiliation information, quiz results, and participation in challenges. We also collect technical data, which may include IP address, device type, operating system, and application usage information.

- Personal data is used for account management, providing personalized educational content, application-related communication, and research and statistical purposes.

- Personal data is processed based on users’ consent, provided during registration in the Application. Users have the right to withdraw their consent at any time; however, this may limit their ability to use the Application fully.
